These Terms of Service (“Terms”) govern your access to and use of Aphelion AI (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Not Financial Advice

Aphelion AI is an educational and informational tool only. Nothing on the Service constitutes financial, investment, legal, or tax advice, nor a recommendation or solicitation to buy, hold, or sell any security. AI-generated analysis, scores, and data may be incomplete, delayed, or inaccurate, and past performance does not guarantee future results. Investing involves risk, including the possible loss of principal. You are solely responsible for your own investment decisions and should do your own research and consult a licensed financial advisor before acting.

Eligibility & Accounts

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

Subscriptions & Payments

• Paid plans are billed through our third-party processors (Stripe and PayPal). By subscribing, you authorize recurring charges until you cancel.
• You can cancel at any time; cancellation stops future renewals but does not, unless required by law, refund amounts already paid for the current period.
• Prices and features may change; we will provide notice of material changes.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Scrape, resell, or redistribute data or analysis from the Service except as expressly permitted.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its systems.
• Misrepresent Service output as personalized financial advice to third parties.

Intellectual Property

The Service, including its software, content, and branding, is owned by Aphelion AI and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes.

The Service relies on market and financial data from third-party sources. We do not guarantee the accuracy, completeness, or timeliness of such data and are not liable for decisions made in reliance on it.

Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Aphelion AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any investment losses, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100.

Indemnification

You agree to indemnify and hold harmless Aphelion AI from any claims, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party right.

Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive termination — including disclaimers, limitation of liability, and indemnification — will survive.

Governing Law & Disputes

These Terms are governed by the laws applicable at Aphelion AI’s principal place of business, without regard to conflict-of-law principles. You agree that any dispute will be resolved in the courts of that jurisdiction, and you and Aphelion AI each consent to their exclusive jurisdiction. Nothing here limits any mandatory consumer-protection rights you have under the laws of your country of residence.

Severability & Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aphelion AI regarding the Service and supersede any prior agreements.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
